Federal court judge rules against Trudeau’s use of Emergencies Act to end Freedom Convoy

Unreasonable and unjustified is the ruling from a federal judge on Canada’s use of emergency powers to end the Freedom Convoy protests two years ago.

Judge Richard Mosley in a decision on Tuesday, Jan. 23 said it violated Canada’s Charter of Rights and Freedoms.

The Federal government is planning to appeal.

Prime Minister Justin Trudeau invoked the Emergencies Act on 14 Feb. 2022, in the third week of protests that had gridlocked Ottawa.

The case was brought to federal court by the Canadian Constitution Foundation and the Canadian Civil Liberties Association.

Last year a public inquiry concluded that the prime minister had met the threshold to invoke the act.
